Explosion injures 30 at Thai Government House

An explosion occurred early on Sunday at the Thai Government House in Bangkok. Thousands of anti-government protesters have been occupying the building for more than 3 months.

Local media report about 30 protestors were injured.

The Government House was also hit by what appeared to be a rocket on November 20th, killing 1 person, and wounding more than 20.

Amid an increasing number of incidents involving explosives, the protestors have criticized the government for not containing the violence.

　2006年、首相やってたタクシンが2006年1月にインサイダー取引をしているという疑惑が浮上。また、取引で700億バーツを得たにもかかわらず2500万バーツしか税金を払わなかったことに国民が反発。
　その後、首相の座を降りるも実質タクシンが裏で政治を操っているということで2006年9月、陸軍がクーデターを起こす。
　クーデターは国王の介入によって収拾、軍事政権が誕生。2007年に暫定憲法が公布され、民政復帰が開始。2008年に選挙が行われるも、タクシンの義理の弟（？）が首相に選ばれる。未だにタクシンの影響が残っているということで反政府（反タクシン派）は議会からのタクシン派を排除すべく今回の騒動へ・・・。

UN Human Rights Council meets on Congo situation

Participants at an emergency meeting of the UN Human Rights Council have condemned all parties, including government soldiers who are involved in the killing and rape of civilians in the Democratic Republic of Congo.

The meeting on Friday in Geneva was called by France, the current chair of the EU, and participants urged an immediate end to violations of human rights.

UN High Commissioner for Human Rights Navi Pillay expressed strong concern over the situation, saying all the parties are contributing to serious violations of human rights as the fighting intensifies.

She said that women are raped and children are abducted to become soldiers.

Congo's governmental representative blamed rebel forces for such atrocities and said the first thing to do is to stop them from fighting the government.

Representatives, mainly from European countries, said that the government is responsible for protecting its citizens and all parties to the conflict, including government forces, should stop such violations of human rights.

The meeting will resume on Monday and is expected to discuss a resolution, including sending a special envoy to study the human rights situation in Congo.

"Pirate ship" sank by India actually Thai vessel

An anti-piracy watchdog says the pirate ship the Indian Navy sank in the sea off Somalia last week was in fact a Thai fishing boat hijacked by pirates.

The International Maritime Bureau, based in the Malaysian capital Kuala Lumpur, made the announcement on Wednesday after speaking with a Cambodian crewmember, the only person that has been rescued from the sunken ship.

The bureau said one crewmember was killed and 14 others are still missing.

The Indian Navy said last Wednesday that they had attacked and sank a vessel helmed by what appeared to be pirates in the Gulf of Aden. Navy ships of various nations are patrolling the sea area due to increased piracy in recent months.
An Indian Navy spokesperson told reporters on Wednesday that armed pirates on board the boat initially opened fire at the navy ship, so it fired back.

The bureau said the Indian Navy may not have received a bulletin that the Thai ship was being hijacked, because it is acting independently from multinational forces such as NATO operating in the area.

China to make a deep interest rate cut

China's central bank says it will cut the benchmark lending and deposit interest rate by 1.08-percentage points each, effective Friday.

The People's Bank of China announced on Thursday that its one-year yuan lending rate will be cut from the current 6.66 percent to 5.88 percent. It said its one-year yuan deposit rate will be cut from 3.60 percent to 2.52 percent.

It will be the fourth rate cut by the central bank since September and by far the largest -- four times bigger than the 0.27 percentage point reductions made on 3 previous occasions.

The central bank said it will also lower the reserve requirement for major Chinese banks by one percentage point on December 5th.

The bank says the latest rate cuts are designed to ensure sufficient liquidity in the banking system and to promote steady loan growth so that monetary policy can play an active role in supporting economic growth.

The rate cuts are seen as a message that the Chinese government is committed to maintaining high growth at a time when China's economy is losing steam in the fallout of the global financial crisis

The World Bank predicted on Wednesday that China's economy is expected to grow by 7.5 percent next year, downgrading its forecast by 1.7 percentage points from its projection in June.

Mechanism of chronic kidney disease unraveled

Japanese researchers say they have identified a mechanism of chronic kidney disorders caused by excessive salt intake.

The research team, led by Professor Toshiro Fujita at the University of Tokyo Graduate School, focused on a protein in kidney cells, Rac1, that is activated by salt intake. The team found the protein excessively stimulates the production of substances that worsen symptoms of kidney disease.

The team then administered a drug that suppresses the functions of Rac1 to mice with kidney dysfunction artificially induced with excessive salt. The team says symptoms in the mice improved.

Fujita says dialysis costs account for 5 percent of Japan's total health care spending. He says he hopes the team's findings can help reduce the burden and lead to the development of new drugs to treat the disease.

In Japan, about 4 million people suffer from chronic kidney disorders without an effective cure and 270,000 of them are regularly treated with dialysis.

The findings will be published in the on-line version of the US medical journal, Nature Medicine on Monday.

　調べでは、水田容疑者は同日午前１０時ごろ、大阪府寝屋川市内を走行中の中之島発出町柳行き臨時特急電車の２階席で、座席の下にミールワームをばらまいたところ、警戒中の鉄警隊員らが確認、逮捕された。

　ミールワームは全長約２センチ。水田容疑者がもっていたリュックサックからは他にミールワーム約３６００匹が入ったケース約１０個が見つかっており、府警はこれらもばらまくつもりだったとみて調べている。

　ミールワームはゴミムシダマシ科の昆虫の幼虫の総称。小鳥など小動物のエサとしてペットショップなどで市販されている。

ASDF to withdraw from Iraq

The Japanese government will officially decide this week to withdraw the Air Self-Defense Force from its mission in Iraq.

The Air Self-Defense Force is transporting troops of multinational forces and UN personnel from a base in Kuwait to Baghdad and elsewhere in Iraq.

In September, the Japanese government decided to withdraw its troops by the end of the year, when a UN resolution on sending multinational forces to Iraq expires.

Following coordination with Iraq, the United States and United Nations, the US has agreed to have its troops take over some of the Air Self-Defense Force activities.

The Japanese government plans to call a meeting with Prime Minister Taro Aso and other cabinet members present, as early as Friday to officially decide on the withdrawal.

Defense Minister Yasukazu Hamada will then send an order to the Self-Defense Forces.

The troops will start preparing for withdrawal while continuing their mission, and return home in late December.

Bullying on Internet rises among Japanese students

A survey shows that bullying in Japanese schools is on the increase.

The survey, by Japan's education ministry, says there were nearly 5,900 cases of bullying using the Internet and cell phones by students in the last school year, up 22 percent from the previous year.

The ministry conducts the annual survey through local education boards to look into behavior problems of students.

The ministry says bullying cases in which cell phones and the Internet are used to send malicious email and post defamatory comments on websites increased by 1,016 cases.

The ministry reports that the total number of bullying cases in schools nationwide stood at 101,000.

That marks a drop of about 20,000 from the previous year, when the definition of bullying was changed.

The survey says in elementary schools, there were 536 cases of bullying using the Internet and cell phones, in junior-high schools --- 3,633 cases, and in high schools --- 1,705 cases.

It also says such bullying accounts for 8 percent of the total in junior-high schools, while it accounts for more than 20 percent in high schools.

The ministry says bullying using the Internet and cell phones can be especially malicious because it can be carried our without the knowledge of teachers or parents due to the high level of anonymity.

Toyota to decrease output further

The world's automobile giant Toyota plans to further slash production to cope with a sales slump amid the global financial crisis.

Toyota says it will stop assembly lines at its 7 factories in the United States and Canada on December 22nd and 23rd, effectively starting the Christmas holiday period 2 days earlier.

It is unusual for the company to suspend all operations, including ones making small cars, whose sales remain fairly solid.

The move is in line with the company's plan to reduce its annual production worldwide by 950,000 cars to around 7.9 million cars.

Toyota already suspended the production of large vehicles at 2 US plants for 3 months from August this year.

The company says it will also suspend night shifts on some of the assembly lines at 2 plants in Japan, which make models mainly for the overseas market.

Japan, US to cooperate on iPS cell research

Japanese and US research institutions are to work together to expedite research on highly versatile stem cells known as iPS cells.

Representatives from the Japan Science and Technology Agency and the California Institute for Regenerative Medicine signed an agreement to that effect in Tokyo on Tuesday.

Induced pluripotent stem cells, or iPS cells, are made by reprogramming adult cells to behave like embryonic stem cells, which can develop into any kind of body tissue.

Researchers around the world are racing each other to put the technology into practical use.

Professor Shinya Yamanaka of Kyoto University, who developed the cells and called for the cooperation of the 2 institutions, told reporters that competition should not hinder the advancement of the research.

But he said cooperation is important to prevent researchers from withholding their findings at a time when people suffering from diseases are waiting to be treated.

California Institute for Regenerative Medicine President Alan Trounson expressed hope that the agreement will promote cooperation among researchers.

研究室のＯＧの方がみえて、いろんな話を聞いた。

就活は来年の今頃から始まる。準備しといた方がいいんかいな。

いまんとこあんま就活に意欲が湧かない。研究は難しいが楽しいし。その研究をほっぽってまで熱を入れる事か…？

自分は何ができるのか、企業で自分は何をするのか。そのあたりに関して色々考える必要があるんかな。

絵文字と著作物

絵文字は著作物なのか？？

こんな疑問が沸いたので。以下調べたことと、そこから派生した妄想。

※ちょっと著作権かじっただけの素人の書いていることなので間違い多数！妄想だよ！

携帯電話の絵文字に、著作物性があるか否か？

直感的に考えると「YES」の回答が得られると思います。だって絵ですから。
著作権法第２条１項１号には
「一　著作物 思想又は感情を創作的に表現したものであつて、文芸、学術、美術又は音楽の範囲に属するものをいう。」
と定義されています。

そうすると、たとえばの絵文字は"晴れ"という思想又は感情を表現したものでありますし、絵文字を作った人のOriginarityがそこに生きてくるでしょうし、これは美術の範囲に属するでしょうから、著作物としての要件を満たしているように感じられます。

しかし、文章で絵文字を使う際のシステムに問題があるように思われます。

PCおよび携帯電話では文字はJISコードやshift JISコードといった２進数や１６進数の文字コードによって表現されています。たとえばカタカナの”ク”は１６進数２バイトのJISコードでは”252f”と表現されています。

絵文字も同様で、私が使っているauではshift JISコードの余りの何も文字が割り当てられていないコードの部分に絵文字を割り振っています。そして、auはau独自で文字コードと絵文字の割り振りを決定しています。だから昔は（一部絵文字は今でも）他社携帯、PCに絵文字を送った場合正しく表示されませんでした。これは他社携帯、PCにはauの独自のshift JISコード割り振りを絵文字に変換するプログラムが入っていないからです。

つまり携帯電話の中で行われている処理は

KDDI用 shift JISコード　→　プログラム（絵文字データ入り）　→　

という形になります。

この形式、フォント又は書式と同じ処理になります。

書式というのは要は文字の形です（ex. 明朝　ゴナ）です。ある書式における全ての文字の形のデータです。フォントはユーザーの指令に基づいて書式から文字を引っ張り出してくるプログラム全体を指すものとです。フォントの中に書式（文字の形のデータ）が入っています。

絵文字も”はれ”という概念を表す書式の一つではないでしょうか？現在はauでもdocomoでもsoftbankでも類似している絵文字は各携帯電話会社間で変換して表示してくれます。ということは”はれ”を表す書式にau版の、docomo版の、softbank版のが存在しているに過ぎないと考えることができます。

では、書式およびフォントは著作物でしょうか？

フォントに関する有名は判例として最判平12.9.6「ゴナU事件」があります。

その判決文において、「印刷用書体がここにいう著作物に該当するというためには，それが従来の印刷用書体に比して顕著な特徴を有するといった独創性を備えることが必要であり，かつ，それ自体が美術鑑賞の対象となり得る美的特性を備えていなければならないと解するのが相当である。」と述べられています。

すなわち、書体そのものに著作物性が認められる要件として

（１）その印刷用書式が従来の印刷用書式に比して顕著な特徴を有するといった独創しえを備えること

（２）それ自体が美術鑑賞の対象となりうる美的特性を備えている

があるわけです。実際に書体に著作物性が認められた判決はなく、よって書体を盗まれたことに対する裁判はもっぱらフォントの”プログラム著作物”の複製権侵害で争われる形になっています。

もし絵文字が１つ書式にすぎないとされるならば、絵文字は「ゴナU事件」の二要件を満たすでしょうか？絵文字はどの会社のものでも顕著な特徴を有するほど独創性を有しているでしょうか？また、絵文字それ自体が美術鑑賞の対象となりうるでしょうか？

答えはNOではないでしょうか？

そうなると絵文字の著作物性が否定されることになります。

この妄想に存在する問題点は、最近良く用いられるようになっている「デコメ絵文字」と対比です。デコメ絵文字はJISコード等に割り振られているのではなく単なる添付画像として文章に埋め込まれます。となると上記の理論はデコメ絵文字には当てはまらずデコメ絵文字は著作物性が肯定されるということになります。
利用者にとってはほとんど同じ効果を持つ「絵文字」と「デコメ絵文字」が根源のシステムの違いというだけで一方には権利があり一方には権利がないとなると問題が生じないでしょうか？

うーーーーん。難しい。どこで線引きをするのがもっとも利益になるのでしょうか。その利益を得るのは誰か・・・。

バイトの関係で某私立大学（偏差値40程度か）の入試問題（国語）を解いたんだが･･･間違えすぎだろ。
まぁ、答えに納得がいかないのも幾らかあるし。判らんがね。

仮託（かたく）って言葉の意味が判らなくて間違えた。

「仮託」は何らかの形で事実でないことを言って偽装・弁解することを意味するようです。事物Ａに関する事実Ｂを言う代わりに、非事実Ｃを言って偽装または弁解することを、「ＡをＣに仮託する」といいます。ただし、必ずしも悪意があることは意味しないようです。

(1)「土左日記は女性に仮託して書かれた」
　検索で多く出てくる用例です。土左日記の著者は男性ですが、架空の女性の筆に託して書かれているということです。

「財産分与に仮託してされた財産処分」
有名な判例らしく、検索でたくさん出てきます。離婚に伴う財産分与を口実にして、自分の財産を他人の名義にし、差し押さえ等を逃れる行為を意味します。

上の(1)(2)が出発点となって、さまざまな場面で「仮託」が使われているようです。（つぎの用例は作り物で、実際に収集したものではありません）

(a）「歴史上の事件に仮託して現代の政治を批判する」
歴史上の事件を述べている文のようだが、実は現代の政治を批判している場合。

(b)「手当に仮託して給与を増額」
手当という名目で給与を増額することです。

(c)「歴史上の有名人を開祖として仮託する流派」
実際にはその人物が流派を開いたわけではないが、その流派ではその人物を開祖として仰いでいるという場合です。

(d)「動物の世界に仮託して人間の行動を風刺」
動物の話をしているように見えるが、実は人間の行動を風刺している場合です。ここまでくると、「口実にする」といった本来の意味からかなり離れ、「たとえにしている」という意味に近づきます。

(d)「人類の将来をこの技術に仮託する」
委ねるという意味で使っていると思いますが、本来の意味から言うと誤用だと思います。

日銀松江支店の資料流出によって酒屋が破綻。風評被害で。

　日本銀行松江支店（松江市）の内部資料が３月、ファイル交換ソフト「Ｗｉｎｎｙ（ウィニー）」の暴露ウイルスでインターネット上に流出した問題 で、資料に「破綻（はたん）懸念先」と実名で記された松江市内の酒店が松江地裁に破産を申し立て、手続き開始が決定された。「風評被害で資金繰りが悪化し た」として、日銀側と進めていた補償交渉が進展しないまま経営破綻に陥った。負債総額は１億５０００万円。

　関係者による と、資料流出後、酒店は卸業者から取引中止や取引量を制限されるなどして、売り上げが減少。一部の卸業者からは以前の取引量に戻す条件として、保証金約 ３０００万円を求められるなどし、経営継続を断念した。店舗の閉鎖後も、代理人を通じて日銀側と交渉しているが、進展がないという。

　酒店の経営者は、破産手続きをしたことで自宅や土地に抵当権を設定され、アパートを借りる資金もないという。経営者は「提訴も視野に入れている」と言う。

　日銀松江支店の臼井正樹次長は「相手のあることなので交渉の内容は話せない。ご迷惑をおかけした企業には申し訳ない」と話している。

　資料は３月下旬、松江支店の男性職員（４月に自主退職）がデータを自宅に持ち帰って私有パソコンで作業し、暴露ウイルスに感染、流出した。
